Bioskin Italia Srl is not responsible for false declarations by the user/purchaser.

Neither Bioskin Italia Srl nor its group companies, affiliates, partners, licensors, and suppliers make any commitments regarding the following:

that the Website corresponds to the User's needs,

that the Website functions continuously, timely, securely and without errors.

that the results that are obtained from the use of the Website (including the information and materials on this Website) will be correct, complete, accurate or otherwise meet your requirements.

This is a public website: you cannot expect any confidentiality in the treatment of User Content you may submit to the Website. Confidential information should not be submitted. 10. Ownership rights on the website

This website is public, and any information you submit will be considered non-confidential. You acknowledge that the submission of any invention included in the User Content you submit constitutes a "publication" of the invention under applicable patent laws. Bioskin Italia Srl reserves the exclusive right to close the Website in whole or in part at any time, for any reason, and without prior notice or authorization. Bioskin Italia Srl assumes no responsibility for the storage or deletion of any Content and/or User Content posted on the Website.

The Website may contain references to specific Bioskin Italia Srl products and services that may not be (immediately) available in a particular country. Such references do not imply or guarantee the availability, at any time, of such products or services in a particular country. For further information, please contact your local organization.

Some products sold by Bioskin Italia Srl may cause damage to property or persons if used improperly or without the guidance of a medical professional. Bioskin Italia assumes no responsibility for any improper use by the customer of products purchased on this site.

15. Resolution of dispute cases

These Terms of Use will be governed by and construed in accordance with Italian law. You agree to the exclusive jurisdiction of the courts of Rome, Italy, in the event of any dispute, claim, or legal proceeding arising out of or in connection with these Terms of Use or your use of this Website, including, but not limited to, any disputes regarding the existence or validity of these Terms of Use.

16. Invalid Clauses

In the event that any provision of these Terms of Use is held to be invalid or unenforceable, such provision will be replaced by a valid and enforceable provision that most closely matches the content of the original provision, and the remaining provisions will continue to apply.

17. Waiver

Bioskin Italia Srl's failure to exercise any right contained in these Terms of Use, in connection with past or future actions by others, will not constitute a waiver of any of Bioskin Italia Srl's rights hereunder. Neither the receipt of any payment by Bioskin Italia Srl nor any reliance by any person on Bioskin Italia Srl's actions will constitute a waiver of any provision of these Terms of Use. Only a specific written waiver signed by an authorized representative of Bioskin Italia Srl will have any legal effect.

18. Shipping and Delivery

The buyer is responsible for the accuracy and completeness of the data provided for billing and delivery.

Bioskin Italia. Srl releases itself from the obligation of delivery by handing the goods over to the shipping company and/or carrier for transportation.

Ownership of the goods passes upon delivery to the shipping company and/or carrier. If the package is damaged, damaged, or shows obvious signs of tampering, or if the package is open, you must notify the courier delivering the package and sign the waybill, adding the words "WITH RESERVATIONS." This protects you if you discover any anomalies after opening the package. Only in the latter case should you report the incident by fax or email to the courier's local office.

In the event of theft or loss of insured goods in transit with our partner courier, Bioskin Italia Srl will forward the refund request to the carrier 30 days after the shipment date; this is in accordance with the insurance agreements conventionally signed with our carriers. The customer has the right, exclusively in the event of theft or loss of insured goods in transit, to request a new shipment of the ordered material, or a refund of the value of the shipped material (excluding shipping costs), only after 30 days (and no later than 60 days) from the shipment date.

Shipments marked "standard" include a first delivery attempt (possible throughout the day) and, if the recipient is absent, a second delivery attempt under the same conditions.

Any storage costs at the courier due to the recipient's repeated absence are to be borne exclusively by the customer who purchased the product.

19. Shipments to non-EU countries – Customs charges and customer responsibilities

All shipments to countries outside the European Union ("extra-EU") are made DAP – Delivered At Place (Incoterms® 2020). The seller only covers the costs of transportation to the delivery address.
All customs duties, import duties, local VAT, customs clearance costs and other incidental charges are the responsibility of the customer .

The customer is required to:

promptly pay the amounts required by the customs authorities of the destination country;
provide all necessary documentation and information for customs clearance.

1. Professional / corporate clients (B2B)

For orders placed as a professional or company (B2B):

The customer is responsible for paying all customs duties and handling customs clearance.
In case of non-payment or refusal of customs clearance:
- The goods may be returned to the sender or abandoned at customs.
- In the event of a forced return , any refund will be calculated net of all costs incurred (outward shipping, storage, return, any return customs charges and other documented costs).
- In case of goods abandoned at customs , no refund will be due.

2. Private customers / consumers (B2C)

For orders placed by private customers (B2C):

The customer is responsible for paying any customs charges and completing customs clearance procedures, as clearly indicated at the time of ordering.
In case of non-payment or refusal of customs clearance:
- The goods may be returned to the sender or abandoned at customs.
- In the event of a forced return , any refund will be calculated net of return shipping costs, storage costs and any other charges incurred.
- In the event of goods abandoned in customs , and therefore not returned to the seller, no refund will be due .

20. Application of conditions based on the type of registration

When registering on the site, the user can choose between two distinct paths:

Registration as a Private Customer (B2C)
Registration as a Company/Professional (B2B)

The choice made during registration determines the applicable sales conditions in a binding manner:

Users who register as a Company/Professional (indicating their company name and/or VAT number) will be considered B2B customers for all intents and purposes and subject to the relevant contractual conditions, including the exclusion of the right of withdrawal provided for by the Consumer Code and the specific provisions for B2B shipments and returns.
Users who register as Private Customers will be considered B2C customers and subject to the contractual conditions provided for end consumers, including the right of withdrawal where applicable.

It is your responsibility to provide accurate and truthful information during registration.
In case of registration as a Company/Professional with incomplete or invalid data, the seller reserves the right to:

suspend account,
request data rectification,
retroactively apply the correct B2C or B2B conditions based on the actual nature of the user.

21. Products for "MEDICAL USE"

Bioskin Italia distributes products for professional use reserved for medical specialists. All products containing the words "FOR MEDICAL USE ONLY" are intended for the exclusive use of medical professionals. Bioskin Italia Srl is in no way responsible for false statements made by users of the site when purchasing such products.
